離婚訴訟における財産分与の裁判と不利益変更禁止の原則
裁判要旨
離婚訴訟において、財産分与を命じた判決に対して控訴の申立てがされた場合、財産分与に関する裁判については、いわゆる不利益変更禁止の原則の適用はない。

所論は、要するに、原審において財産分与の額について被上告人(被控訴人)から不服の申立がないのに、原審が第一審判決を上告人(控訴人)の不利益に変更したのは、民訴法三八五条に規定する不利益変更禁止の原則に反して違法であるというものである。
しかしながら、人事訴訟手続法一五条一項の規定により離婚の訴えにおいてする財産分与の申立については、裁判所は申立人の主張に拘束されることなく自らその正当と認めるところに従って分与の有無、その額及び方法を定めるべきものであって、裁判所が申立人の主張を超えて有利に分与の額等を認定しても民訴法一八六条の規定に違反するものではない。したがって、第一審判決が一定の分与の額等を定めたのに対し、申立人の相手方のみが控訴の申立をした場合においても、控訴裁判所が第一審の定めた分与の額等が正当でないと認めたときは、第一審判決を変更して、控訴裁判所の正当とする額等を定めるべきものであり、この場合には、いわゆる不利益変更禁止の原則の適用はないものと解するのが相当である。
原判決に所論の違法はなく、右違法のあることを前提とする所論違憲の主張は、その前提を欠く。
